Due Diligence Support

The Due Diligence Process is the best (and sometimes, the only) shot for companies on either end of any transaction to provide or obtain what they most need to succeed. Surprisingly, however, it is consistently the most under-appreciated and poorly utilized tool in the industry.

Preliminary Site Analysis

e2k provides preliminary Site Analysis and Early Evaluation of any proposed Property to help the Client determine if the desired Use is a good fit.

Local Code Review

e2k will review Local Code requirements for Zoning and Use and help the Client coordinate any needed Purchase and Sale Agreement (PSA) timelines.  

Risk Evaluation

With a background in architecture and development, e2k recognizes the importance of getting all applicable issues on the table quickly so the Client can better evaluate risk vs. reward early in the process.

Complete Process Management

e2k has the knowledge and the ability to manage the entire due diligence process for the Client – from gathering and evaluating Design Sub-contractors, to scheduling and attending preapplication meetings with the Jurisdiction, to reviewing completed Site Studies (Phase I – ESA, Soils Reports, Surveys, etc.) and helping the Client determine best practices.

Development Costs Analysis

e2k recognizes the value in accurately determining all development costs for every project. e2k will coordinate with design subs and local authorities to determine development fees, any on-site and/or off-site improvements required by governing authorities, and even populate a Preliminary Investment Report (PIR) that can allow the Client a snapshot of all known development fees (SDCs) and permit fees required to get final approvals for a project.  This allows the Client to comfortably understand the general requirements that need to be considered when talking to investors and/or lenders.

Land Use + Entitlement

The development entitlement process, or the land use entitlement process, is the legal process in which a real estate developer or landowner seeks to obtain government approval for their development plans. The developer must secure all required entitlements, including zoning, density, design, use, and occupancy permits before they can begin to build. The entitlement process can be long and complicated, but it’s the most important part of the development phase!

Land Use Planning

e2k coordinates with the Client to ensure the most economical and approvable site design.  Scrutinizing gathered information in due diligence and organizing a plan to incorporate all required criteria in order to achieve Land Use approvals, alleviating some of the tedious, but necessary, work and stress.

Neighborhood/Public Relations

Whether it is required by the jurisdiction or a part of a Client’s outreach in the community, e2k recognizes the importance of a Neighborhood Meeting with adjacent uses or residents. The importance of the first impression to the neighbors is immeasurable. e2k will organize all team members and information to ensure accurate and flattering imagery is produced for introduction to the neighbors. e2k has the ability to receive any neighbor comments or concerns and help the Client with best options to address, if any acknowledgement is warranted.

Applications and “Burdens of Proof”

e2k is skilled in reviewing all applicable Codes and producing any written arguments or “Burdens of Proof” to accompany the design team efforts in a Land Use Application submission. e2k will coordinate with design team members to confirm the Client’s design is completed as requested, and all required materials are prepared for submission to reviewing agencies.

Attorney Acquirement

e2k can help the Client determine if an Attorney will be required by the jurisdiction and help the client source / hire the proper attorney for the project. e2k can assist the Client in managing the attorney’s time and limit their involvement to needed tasks.

Jurisdictional Meeting/Hearing Facilitation

e2k has countless hours of experience with reviewing agencies including Design Review Boards, Planning Commissions, City Counsels, etc. e2k will facilitate any jurisdictional meeting or hearing required for the approvals of the Land Use Application and coordinate with the Client on execution of land development or subdivision related agreements and posting of financial securities as required by the appropriate agencies.

Project + Construction Support

Lender Request Coordination

e2k will coordinate typical lender requests as instructed by client including but not limited to, zoning verification letters, updated Phase I ESA and Phase I/Geotech Reliance Letters.

Construction Monitoring

The Client’s architect will provide a Site Evaluation for Code related Fire and Life Safety requirements, but having a background in architecture, e2k has the ability to provide the Owner with any requested Construction Monitoring or Owner Requested Construction Review and Pre-Punch, ensuring Client Standards of Construction for fit-and-finish are adequately met.

Closing Documentation

e2k will coordinate with the Client and confirm any closing requirements or documents with Local Jurisdiction, lenders, etc., including requesting an As-Built ALTA survey and reviewing for accuracy and schedule information, making sure that when the Client is ready to occupy the project, all Permits and Certificates of Occupancy are obtained.
